the first part of this section; and make return of the same to
the clerk of the said court, and said clerk shall under his hand
and seal transmit a copy of the return of said commissioners to
the court in wuinch the succession was opened.
CE'rTioN 7. Be it fmiter timn ted, That the court at its first
term after such petition for dower is filed, shall proceed to hear
and determine as to them shall secr just and right. Provided,
That the party petitioning for dower shall give toVi days previous
notice to the executors or administrators, or children of such de-
ceased person, or to their representatives or to their gmardians if
they be minors, by service as in other cases; and where there
are no executors or administrators, or children or their represen-
tatives, or when the widow is the executrix or administratrix,
then she shAll give notice by advertisement in the newspapers
published nearest the county in which the succession is carried,
and once a week for four weeks.
Su:vrmi4 8. B, it furihrr enacted, That it shall be lawful for
the widow to retain full possession of the dwelling house in
which her husband most usually dwelt next before his death, to.
gether with the out houses, offices or improvements, and planta-
tion, thereunto belonging, free from molestation and rent, until
she shall have her dower assigned her.

SETION 1. Be it enacted by the Senate and House of Rep-
resentatives of the Republic of Texas in Congress assembled,
That from and after the rising of every court, it shall be the du-
ty of the clerk thereof to tax the costs of suit incurred by the suc.
cessful party, and for which judgment is rendered, di-tin(ruish-
ing between the plaintiff's attorney's and sheriff's fees, and issue
execution in the following form:
The Republic of Texas to the sheriff or coroner, ,as the law may'
