tiff in execution, there #hall be renderud against such sheriff, a
judgement for the account due upon the execution, with ten per
cent damages, and also ten per cent interest per month until the
whole um.rnt shall he paid; provided, that tie party moving
for such judgement sihall have given to the slheriff at least three
days notice before the motion made, which jud-inent may be
rendered before any court of rec'rd in the county where such
execulion wias issued.
8Kc. t2. Be it further enacted, That in any case where
the Sheriff is a party to the suit, all prciess shall be executed
by the constable of the township where thecourt is held,in cases
where there is no coroner in the county, or if lie be absent from
the scat of justice e fthe county at the time the process is obtained,
and in such cases the constable shall have jurisdiction co-exteu-
sive with the county.

AN ACT
To antind the direct tax lam irs,
ze. 1. Be it enacted by the Senate and House of Repro-
sentatives of the Republic of Texas in Congress nsseniled, That
it shall be the duty of the Assessors so soon asthey may be iirtified
of their appointment to advertise in, at least, three of the most
public places within each captains heat, giving at least twenty
days notice, to till persons living within the botunds of the same,
that he will attend at the mustering grounds for said heats on a
particular day or days for the purpose of receiving a list of tax-
able property, at which time and place lie shall attend and re-
main a vufficient length of time to enable all persons who may
attend to give in their several lists.
Src. 2. Be it further enacted, That each and every person
giving a list of their t axblc property shall take the following
oath, to be administered by the assessor, or some other person
duly authorized to administer an oath.
