Suc. 2..Be it jurther enacted, That all witnesses, sum- moned before any grand jury in this State, shall receive the same pay as other State witnesses, and shall be taxed to the unsuccessful party, as costs taxed in other cases: Provided, that where no indictment or present- ment is found on the evidence of such witness, the cost shall be paid by the county where such witness is sum- moned.
