SECTION 1. BC it enacted by the General Asstmibly of 1te Sate of Tennessce, That thc Mayor and Alderman of any in- corporated town in this State, are hereby authorized to use and employ on the streets, alleys, &c., for the improvement of such town, any slave or slaves committed to anid now in Jail, or that may hereafter be committed to the Jail as runaway slaves, in the county where such incorporated town or towns, or cities may be; and it is hereby made the duty of the keep- crs of such Jails, upon application, to deliver to said Mayor and Aldermen, or their agent, any slave or slaves thus con- ,fined in any jail in his care and keeping, upon the condition that such Mayor and Aldermen shall first execute the Bond of the Corporation, payable to the Sheriff of the county, and his successors, in double the value of said slave or slaves, conditioned for the safe-keeping, good treatment and delive- ry of said slave or slaves io the owner or owners, upon appli- cation by such owner or his agent, in accordance with the existing laws, or to the Jailor upon the expiration of the pe- now prescribed by law, for the confinement of runaway slaves, and for the payment of all costs and expenses incur- red on account of said slave or slaves, except thecost of ar- rest, commitment and advertising of the same; Provided, that before any such slave or slaves shall be given over to such Mayor and Aldermen, the said Mayor and Aldermen shall first procure a written statement fiom the Sheriff, that he has received a satisflctory Bond as required by this act; and said Mayor and Aldermen shall on the reception of any such slave or slaves, record on their Journals, an accurate descrip- tion of' each and every slave so received, to be advertised in the event of escape, as now provided by existing laws in such cases.
