CHAPTER LXI.
AN ACT prescribing the duties of executors and
administrators in certain cases.
Exec. or nil SEC. . e eitenacted by the General Assembly of
min's. to sell the State of Tennessee, That no executor, or admin-
slaves, except istrator, shall make sale of the slaves of his or her
as hereafter testator intestate unless directed by the will of the
prescribed.  testator to do so, except in the manner herein af-
ter pointed out.
SEC. 2. Be it enaCted, That if any executor, or
administrator shall think it necessary to sell, or
dispose of any slave, or slaves, for the payment of
County court debtq, or where it is for the interest of the legatees
upon petition or those entitled to distribution to make such sale,
to direct sale
&slaves.   or where a division cannot be made among the
legatees or distributees of the estate without sale
in all such cases such executor or administrator
shall exhibit his petition to the county court of the
county in which the will is proven or letters of ad.
ministration granted setting forth the causes why
such slave or slaves ought to be sold which petition
shall be sworn to, and if on the hearing of such
petition, and any evidence that may be adduced,
the court shall be satisfied of the truth thereof, and
that such slave, or slaves ought to be s'old, they
may order, and direct the executors or administrao
tors to do so, and all sales of slaves made by exe-
cutors, or administrators contrary tn the provisions
of this act hereby declared to be void.
