4.N  ACT, providin for cases where justices
of the peace have did,; renoved, or resigned.
S actIoN 1. Be it enacted by the General As-
Clerks (0 is- seiibly of the State of Tennessee, That from and
toe ther   after the passage of this' act, when itshall appear
when neces that judgments renlered by justices of the peace
ary. in this state, who have died, removel, or resign-
ed, are unsatislied ; on application of the agent or
attorney, it shall be lawful for the clerk of the
county court in whose office such papers may be-
filed, under the acts of Assembly now in force, to.
issue execution on said judgments, to any county in
this state, frorn which execution the plaintiff shall
receive the same benefit and the officer into whose
hands the same may come, shall have the same aul-
thority to proceed, as if the -execution had issued
from a justice of the peace on a judgment render-
ed by him in the county to which. the same may
be directed.
SEC. 2. Be it enacted, That, it shall, be the dd.
ty of the ofilicer to whose hands such execution
shall come, to retlrn the same to the clerk by
whom it was issued in forty days from the tinie he
may have received such execution, and shall be
lialle for neglect of duty in such case, in the same
manner as oficers are liable in failures to return
executions and pay over money in other cases.
SEc. 3. Best enacted, That the officers execut-
ing the foregoing process, shall be entitled to the
flicers fees same compensation as they now are in similar ca-
es, and the clerk issuing tie same, shall be entitled
to fifty cents therefor to be taxed as costs on the
writ.
