Be it enacted by the Senate and House of Representatives, now met and sitting in General Assembly, and by the authority of the same, That te fifth section of an Act, entitled an Act to reduce all the Acts and clauses Act of 1825, of Acts of the General Assembly of this State, relating to the powers and Amended. duties of the Commissioners of Roads, into one Act, ratified on the tenth day of December, A. D., one thousand eight hundred and twenty-five, be so altred and amended as to read as follows: That each Commissioner of Roads hereafter to be appointed or elected by the Legislature, is hereby de- clared liable to serve as Commissioner for the term of four years from the Commissioners date of such appointment or election, and until the first Monday in February yea.r next after the expiration of his said term; but shall not be liable to serve against his will until the end of four years from the expiration of said term; and if from any cause a vacancy shall happen in any Board of Commis- sioners now organized, or hereafter to be organized, such Board, or a majority of them, shall have power to fill such vacancy by the appointment of another vacancy, how Commissioner for the remainder of the term, who shall likewise be exempted sued. from serving again for the term of four years, after having served the term of such appointment. II. That Commissioners appointed by the Legislature as aforesaid, shall meet and organize their respective Boards on the first Monday in February, Time of Moot- next after their appointment, at their usual place of meeting; and upon the sug. failure of any Commissioner to meet for that purpose, he shall be liable to the forfeiture contained in the eighth section of the Act of eighteen hundred and twenty-five, aforeaid. III. That the several Boards of Commissioners of Roads now organized, or hereafter to be organized, are hereby authorized, at their discretion, to let Dutles of com. to contract to the lowest bidder, for working and keeping in repair for the missionors. term of one or more years-not to extend beyond their term of office-the whole or such parts of the roads within their respective jurisdictions as to inch Board shall seem advisable, taking from such contractor his bond, with ap- proved sureties, in the penal sum of double the amount of the price to be paid for each year the contract has to run, specifying the manner the section of road is to be worked and kept in repair, for the term aforesaid, and con- ditioned for the faithful performance of the covenants therein contained, one of which covenants shall be that the contractor shall have the control of the labor of the hands liable to work the road specified in his contract, at such rate per day as shall be agreed upon, and receive such sums of money arising from a scale of commutation, as shall be fixed by the Boards of Commis- sioners respectively within their jurisdiction, as is hereinafter provided: Provided, That no Commissioner shall be allowed to be a contractor for 71 758
