Be it enacted by the Senate and House of Representatives, now met
and sitting in General Assembly, and by the authority of the same, That
from and after the passing of this Act, it shall be the duty of magistrates
and freeholders, who shall convict any free negro, slave, or other person of
color, subject to the jurisdiction ol'such Court, of any capital offence,
and sentence such person to capital punishment, to direct the warrant of
