And where the Defendant shall so .ppear, and plead to the declaration as aforesaid, the judgment, if against the Judgmen finaL )efendant, shall be final and conclusive, and the Plaintiff shall be entitled to ue out writs of execution thoreon, both of capias ad satisfaciendum and of ori facias, or either of them, to be lovied generally of all the estate and effects f the Defendant ; and nothing herein contained shall be held to impair the ion of the Writ of Attachment on the property originally attached, or to en. itle the Defendant to dissolve the attachment without putting in bail to the ietion : Provided, That no judgment against an absent debtor, in an action Proviso. )f foreign attachment, except where the Defendant appeared by warrant of ittorney, or by putting in bail to the action, shall have any operation or effect, axcept upon the property originally attached; but upon any action of dubt upon such judgment, or any scire facias to revive the same, the said Defendant shall be entitled to set up any defence, which might.have been made to the original action: Provided, further, That where any judgment, founded on an attach. Proviso. ment, wherein the Defendant has not appeared or put in special bail, shall not be satisfied by the proceeds of the property thereunder attached, the plea of the Statute of Limitations shall not be held to bar any suit brought on the cause of action on which the said judgment is founded, or to any action on the said judgment in such attachment. ANY SLAVE ACCUSED OF A CAPITAL CRIME. Be it enacted, by the Senate and Iouqc of Representatives now met and sitting in General Assembly, and by the authority of the same, That in case the Master or other person having charge or government of any slave who shall be accused of any capital crime, slall conceal or convey away any such slave, so that he cannot be brought to trial and condign punishment, every master or other person so offending, shall forfeit, on conviction thereof, one Penalty. thousand dollars, and sufFer iimprisonment at the discretion of the Court not exceeding twelve months, which forfeiture aforesaid shall not be barred for want of prosecution at any time within two years after the commission of such offence.
