.other thing: And if any such person shall tiot have and Me. 18W.
keep constantly such a flood gate, lock or other passage, t
or when required, shall not open the same, for the pas-
sage of rafts, boats or ither things as above mentioned,
such dam, lock, flood gate or other passage, may be cut
open by the direction of a magistrate and freeholders, in
the same manner and by the same proceedings as rice
dams may by law be cut; and the owner or possessor
thereof shall be liable to be indicted, or to be sued by
special action on the case.
And be it further enacted, That Christian Briethaupt4
M. C. Levenworth, John Tarrance, Wade Hamptonjun4
and Arthur Simpkins, he, and they are hereby authorized
and empowered to superintend and direct the opening of
the said str am, and the r, moval of existing obstructions.
And be it also enaf;ed, 'hat an act, entitled, An act
for. the relief of Jesse Hountree and others, owners of
mill dams on Horse Creek, passed on-the nineteenth day
of December, in the year of our Lord one thousand eight
hundred and seven, be and the same is hereby repeakd.
In the Senate House, the twemieth dap of Derember, in the Year of our
Lord, one thousand eiht hundred and trenty, and in the forty-ffth
Year of the Independence of the United States of.4nerica.

An ACT to vest the title of a (ertain tract of land in Tho-
nas Petticrew, and for other purposes.
W HEREAS Susanna Boggs, late of the district of
Richland, was at the time of he r death, st ized in
fee of a certain plantation or tract of land in said district,
on Toms creek, containing - acres, more or less, and
departed this life intt state, without leaving any person
eapable in law of taking said lands by inheritance:-
And whereas it hath appeared, that Thomas Petticrew, a
nephew and nearest of kin of the said StIsannia Boggs, hath
prayed the legislature, that title to the said tract of land
may vest in him ; and hath in his petition set forth, that
though he is an alien by birth, he hath made a declaration
in due form of law, of his intention to become a citizen of
the United States:
BE it therefore enarted by the honorable the Senate and
House of Representatives, now met and sitting in general
assenblU, and by the authority of the same, That the title
of the state to the said tract of land be, and the same is
hereby vested in the said Thomas Petticrew, his heirs and
