An ACT for the prevention of fivoloNS appeals.
B     E it nacted by the honorable the Senate
and Bjouie of1?epresewnaives, now met and
sittig in'general assembnly, andby  tie latzhority
of the same, That in all cases of appeals from  the
decision of the circiuit courts'oflaw within this state,
rmw pepding' or, here:01er- to he made, the Opinion
of the judge who tried the cause shall be taken
and hfaite -equal'effect -witi that of arn other itrm-
ber of the Lcon'stitutionat court: Provided nater-
theless, the coiirt shall not consist of less thanifive
judges.
SAlde it encKed( by the aut hority, aforciEd, That
whenever on any appeal hereafter to be made from
the decision of any circit court of law or C(lUity
withhi this state, the Oinal-decision ,hall be against
the appellant, or he hli0l vithdray his appeal, in-
terest on the amourit recoviercd,t'halilte allowed, at
the rate ofsevereIr ce.t. coon the dtv the verdiet
or decree was given to dfle tiiewihen such appeti
shall be dismissed or 1vithdrawNO

the interest hereby ailowed, shadl be endorsed oi
the back ofrthc execution, and collected by the she-
riff with tie original debt.
