AN ACT TO PROHIBIT THE E3IANCIrATION OF SLAVES BY WILL.  Gha
Be it enacted by the General Assembly of the State of Noare to be
North Carolina, and it is hereby enacted by the authority nlpateby
of the same, That no slave in this State shall hereafter be
emancipated by last will and testament, or deed, or other
instrument or conveyance to take effect as to said eman-
cipation after the death of the testator or person execu-
ting or making such deed, or other instrument or convey-
ance, but that all such wills, deeds or other instrument
or conveyance in so far as they purport to effect such
emancipation, shall be null and void; and no slave so at-
tempted to be emancipated, shall pass under any general
residuary clause in any last will and testament, but the
testator shall be deemed and taken to have died intestate
as to such slave. [Ratified the 31st day of January, 1861.]
