Be it enadcted by t1e Genral Ae.88076ly of the State Commisaloners of North&-Uarolina, and it is hereby enacted by the authiority te eane, That M. S. MeCorkle, S. G. Mfiller, George 0etzer, . Campbell and D. B. Gaither, and their successors in offiee, be and they are hereby appointed commissioners for the town of 'Newton, in the county of Catawba, and the said commissioners and their successors are hereby incorpo- rated into a body corporate ahd politic, by the name of the Commissioners of the town of Newton, and by that name may have succession, may sue and be sued and have a com- mon seal, and by such name may have power from time to time, and at all times thereafter, to adopt such rules and regulations, and pass such by-laws -and ordinances as by them or a majority of them may be deemed proper and ne- cessary for the order and good government of said town; and such rules, regulations, by-laws and ordinances, so pass- ed shall be as binding as if herein especially enacted: Pro- vided, they are not inconsistent with the constitution of the United States or of this State: a majority of the said com- missionors shall constitute a quorum for the transaction of business. Sitc. 2. Be it fiurther enacted, That no person sludil be ol- Eligibility. igible to the office of commissioner of said town, unless he shall have resided therein twelve months next preceding his oloution; and no person shall be entitled to vote in any elec- tion for commissioners in said town, except free white men of the ago of twenty-one years, who shall have resided in said town for twelve months preceding the election. Sa. 3. Be it further enacted, That the commissioners hereinbefore named shall hold their office until their suc- cessors shall be elected and qualified as hereinafter pro- vided for. SEC. 4. BO it further enadted, That the Bhoriff of Catawba Duty ofahoriff. county, or his deputy, shall, on the first Monday of Januna- ry, in the year one thousand eight hundred and fifty-six, and on the first Monday in each succeeding year, of 3anu- ary, hold elections for five commissioners in said town, in the manner folloving, to wit: He shall hold the elections in the courthouse in Newton, after giving ten days previous notice by advertisement in said town; the poll to be open- ed at 10 o'clock and closed at sunset: he shall summons two freeholders in said town to inspect and superintend the elec- tion, and within five days thereafter shall give the persons elected notice of their election; and shall also, within the same time, file with the commissioners of the town for the time being, the poll books and a certificate in writing of the 848-
