CHAPTER CCXX.
AN ACT to amond an act to incorporate the Hickory Nut
Turnpike Company, passed at the session of the General
Assembly of IS40-'41.
Soc. 1. e it enactd@hy the General .2ssembl oft/he State of
Xorth Carolina, an,! it is hereby cateled by the aithority of the
Samc, That hi after all persons liable to work on public
roads, living within one mile of the Hickory Nut Turnpike
road, shall be compelled to perform at least six days labor
oi said Hickory Nut Turnpike road, at such time as the
president of said road shall appoint for the benefit of said
road.
Sec. 2. Be it furlhcr enacted, That all such persons as are
required by the preceding section to work on said road, shall
be exempt from perforning labor on any other road.
Sec. 3. Be i! funrther enarled, hat if any person, liable
to work on said turnpike road by the first section of iltis
act, shall refuse or neglect so to do (after notice duly givn
for three days) he or they so neglecting or refusingr, shall
torfeit and pay to said company fifty cents for each and ev-
cry day he or they shall sO neglect or refuse, to be recovered
in an action of assiopsit, before any justice of the peace ot
the county in which such delinquent resides.
. 4. Be it further nac/cd, That if any slave or any
person bound to servitude shall refuse or neglect to work on
said road, the pounaly slhall be recovered from the master or
owner of said slave.
