rsone shall, on any pretence whatever, by'means of a dam, weir, trap or
therwise, from and after the fifteentli day of March next until the first day
of June, so obstruct tile channel of New river, from the Virinia line to the
confluence of the Sbuth and Nt,rth forks of said riv eri in A se county, and
fromn thence to the Three Forks of the South Firk of New river, in Ashe
county, as not 'to leave one-fourth of the said riv'r, in the deepest part of the
main channel open for the free passage of fish; aniidany person violating the
true meaning anl intent of this act, shall be liable to indictment for each
and every offence, and upon conviction shall be fined at tile discretion of
-the court.
II. Be it further enacted, That any person or persons who have hereto-
fore erected or caused to be erected, or have any interest in any dam or o-
ther impediment, so ve; not to leave open one-foirth part of the river as a-
bove set forth, and who shall not, on or before the fifteenth day of March
next remove or cause to be removed any such obstruction, shall be liable to
indictment, and on conviction shall be lined at the discretion of the court.
III. Be it further enacted, That all laws and clauses of laws coming with-
in the meaning ani purview of this act, he, and the same are hereby re-
pealed.

and it is hereby eoacted by the adhority o' he same, That frornm and after
the first (lay of' February next, it shall not be lawful for any person or
persons to obstiuct, by telliig trees therein, the run Of the south-'west
branch of Nev., river, in Onslow county, from the niouih to the Holly Shel.
ter road, leading from the rich lands of New river to Wilmington, North
Carolina, and the other branches called Mill Run to lenry 1Vard's land-
ing, under the penalty of' ten dollars for every such obstruction, to be
recovered before any jurisdiction having eogniz.ance thereof by any inform-
er, one half to his use, and the olher half to the use of the wardens of the
poor of said county: Provided, that no'hing herein contained shall be so
construed as to prevent the owners of lands on said rtins or creeks or
swamps from building water fences or mills thereon; nor shall any person
incur the penalty herein prescribed who shall fell timber in or otherwise
obstruct the runs of said creeks or swamps in clearing and improving his
or her lands, provided the same shall be removed in ten days; and all
owners of slaves shall le liable, under the provisions of this act, for all
violations of this act by their said slaves.

creek, from its mouth to James Owen's mills, in the county of Bladen, be,
she or they shall forfeit and pay the sum of twenty dollars for each and
eery olr'ence, to be recovered before any justice of the peace having cog.
