'5IX Be if/trther enacted, That the General Assembly may at any time hereafteir repeal, modify or alter this act: Provided, however, thrit said re. peal or alteration shall not affect vested rights. CHAPTER CXIX An act to amend an act, passed at the hist session, entitled !' an act for the better regulation of the town of Washington, and for other purposes. Be it enacted by the General Assembly of the State of North Carolina, and it is hereby enacted by the authority of the same, That from and alter the ratificatior. of this act, Ihe commissioners of the town of Washington, in the county of Beaufort, shall not be required to establish or maintain a peroma- vent night watch in said town; but they shall possess a discretionary pow- er to establish a night watch whenever, and as often, and contiue the same so long as in their opinion the safety of the town icquires it; nothing how, ever herein contained shall be construed to impair the discretionary power vested in said commissioners by the before recitud act of forming said watch by the classification of the free white men of said town in th', manner men- tioned in said act, or by hiring watchmen. II. Be it further enacted by the authority aforesaid, That the several jus- tices of the peace residing iti said town shall have concurrent jurisdiction with the intendant, of all actions and causes of action for breiches of aiy of the laws or ordinances of said, town; and any party dissatisfied with the judgment rendered by any justice or by the intendant, shall have the right of appeal to the Court of Pleas and Quarter Sessions of said county, under the same rules and regulations as are prescribed in other trials before justices of the peace; and if the defendant be a slave, his or her master, mistress or owner shall have the right of appral, by giving approved security for the per- sonal appearance of said slave at the said court, and for abiding by and per- forming the judgment of the same; and the 4id commissioners shall, in all cases, have the right of appeal without giving security for costs, but shall order the treasurer of said town to pay the cost or fees of any suit in which they are parties, and for the payment of which they shall be liable or ought to pay. And it shall be the duty of the county attorney of said county to professionally attend to and prosecute for said commissioners all such suits; knd the said attorney shall not exact of said commissioners any hig-her fee for any such service than is by law allowed; and wherever the tax fee in any such suit shall lie collected out of the opposite party, the said attorney shall take the same, and no other, for his compensation forattending to such suit. Ill. Be it further enacted by the authority aforesaid, That ihe said com- missioners he, and they are hereby prohibited from levying or collecting any kind of tax whatsoever for the use of said town, except those taxes which are nuthorised in and by the before recited adt, and also those taxes which are authorised by the act regulating said town, passed in the year one thousand seven hundred and ninety-nine, chapterone hundred, and also sibch taxes or as is by law given, or may hereafterpe given to said town upon siilei
