CHAPTERI CXXIV An act for ice better regulation of th Court of Il'icns oad Qunarter Sessions for the county o Waynev. lie it enacted by the General .Issembly of the State ty' North Carlina, ad it is hereby enacted by the authority ' the same, That the jllstices of the Court of Pleas and Quater Sessions for the county if Wayne may, and they are hereby authorised, at the first term of' said court after the first day of Fbtiruary next and at the firt trm iof ad court after the first day of Fbiruary in each ani every year ihereafter, it) elect from aimonig themselves five lit persons to tohd ilic' said courts of saul county, three of whom shall be a compctent number to hold the said court and discharge the duties thereof. 11. .1hid be it fther enacted. that the live pcrsons so elected, or a ma- jority of tjiem, shall be competent to do and perform any business, matter or thing, which, by the present laws. seven justices are authorised to per- form; and they shall in) all cases be governed by the same rules, regulations and restrictions as govern other County Courts in the State; and the said justices so elected shall be entitled to leceive each a sum not exceeding three dollars, nor less than one dollar per day, which sum shall be fixed by a majority of the justices of' said county, for their services during the timo they are employed in the discharge of' their duties in said court; which sbull be paid by the county trustee, upon the certificate of the clerk of said court, shewing how nany days any such justice so to be elected as by this act re.- quired shall have holden the said court. 111. /Ind be it further enacted, That the justices of the Cotrt of Pleas and Quartcr Sessins aforesaid shall annually lay a tax suflicient to (felt ay the expenses necruing by reason of' the provisions of this act; which tax shall be levied, collected and accounted fI' by the sheriff of said county, to the same manner, and umolr the same penalties as other county taxes are by the existing laws of this State; any law, usage or custom to the contrary notwitistanding. That in all elections under and by this act, it shall be necessary that a majority (if the acting justices of said co1untyt' shall be present at the time; aiinl that this act shall bte in force from and alt- ter the first day of' February next.
