CHAPTER LXI. An net appointing comnissiorers to Iay out a road from Salisbury to Lincolnton. Be it cuacted by the General Assemhbly of the State of Aortlh- Carolina, and it is hereby enacted by the authority of 'the iame, That Alexarnder Tor- rence, John F. B3revard, and John Andrews, be, and they are hereby appoint- ed commissioners to lay out a road from Salisbury to Lincoluton, the most convenient and best route, or so much and such part thereof as the public interest and convenience shall require, to be laid out, altered or changed from any route or routes now used as public highways; and such road, when so laid out, shall be opened and kept up in the manner now prescribed by law for opening and keeping up public roads. II. Be it further enacted, That the said - omilissioners shall file with the clerks of the Court of Pleas and Quarter Sessions in the respective coun- ties through which said road shall pass, a chart of the same, and shall re- ceive a per ditm allowance of two dollars each for their services, to be paid in equal proportions by the counties through which said road shall pass; the said conuntssioners first apportioning their claims and filing them with the report required by this act. Ill. le it further enacted, That the said commissioners shall appoint o- verseers and designate the part or parts of the road the respective overseers shall open and keep up, and shall assess daumages, setting forth the amiount and to whom allowed, and report tie same in writing to the respective Coun- ty Courts, which shall be paid by the counties where the lands are situale. IV. Be itfurther cnctetd, That the County Courts shall order and direct notices to be given to the several overseers in the same manner as now pre- scribed by law, and shall order and direct the expense and daiages to te paid by the county trustees agreeably to the report and estiiate of said coom- TISS10tlers. V. lie it further eacted, That all laws Coning within the purview and meaning of this act, are hereby repealed. CHAPTER LXII. An art conerning, net Make- in Paimplio River anid Con. Soutul, ill Carteret coilnty. Be it enacted byi the General .Tssenbly o* the iState of YAorth-Carolina, anid it is hereby enacted by the authority qf the same, 'Ihat in future, all such persons as shall put down stakes in PIamplico River, below the bridge at Washington, in the county of Heaufort, or in Core Soutid, in Carteret county, for the purpose of fishing for shad or other fish, shall remove the saic out of the river and sound on or before the fifteenth day of April in each and every year; and in case anv person or persons So of~enlding, shall fail to comply with the provisions of this act, he, she or they shall forfeit nd pay for each and every neglect in so doing, the sum of twenty dollars, to be recovered before any jurisdiction having cognizaince thereof. If. .1nd be itfurtlhcr enacted, That if anly slave shall violate the pro- visions of this act, and being lawfully convicted thereof, shall receive on his or her bare back not less than twenty lashes, and his or her tmaster or mis- tress, or the guardian of' any minor orwning said slave, hall pay the cost of :uch prnsecution.
