. CHAP. XLV.
. An act iiposing an annual tax on Stud Horses and Jack Asses.
Be it enacted by the General .hssembly oj the State tfi Aorth.
Carolina, and it is hereby enacted by the authority of the same,
That a tax on all Stud in ses and J ek' Asses within this state,
of the highest slim which the owoer or keeper of such Stud Ratesof taxes
Horse or Jack Ass shall ask or receive for the season of one
mare, shall be levied, collected and accounted for ; and all Stud
Horses and hack Asses which are not stationed in any s ne coun-
tY, and all those that may be brought from another s'ate to stand
for a less term than the season in this state, shall pay the she-
riffof some county the amount of the season, as soon as the sea-
son of such Stud Hirse or Jack Ass shall commence, or pro-
duce a certificate from 'a Justice of the Peace from the county
from whence such Horse or Jack Ass came. (if in the state,) that
such Stud H rse or Jack Ass has been enlisted for taxation:
and it shall be Tlbe duty of the sheriflfto collect the said tax;
.and an failure of the owner or keeper of such Stud Horse or
3ack Ass to pay the; same when demanded, it may be lawful for
the sheriff to destiain for the same by seizing such Stud Horse
or Jack Ass, and mi.ake sale thereof for the tax.
S11.' And be itfurther enacted. That all owners or keepers of
Stud Horses and Jaick Assesshall enlist.the,same for taxption as Stud horses&,
other taxable property is enlisted ; and on failure of such own, ,jack asses to
or keeper to enlist such Stud Horses or Jack Asses as afore- be inlisted for.
