CHAPTER CC.
AN ACT to provide for the taking of the Census of the
State of Mississifipi, in 1860.
SECTION 1. Be it enacted by the Legislature
of the State of .lfiisissippi, That it shall be the
duty of the assessor of taxes of each and every Duty of
county in this State, to make an exact enumeration assessor.
of each and every free white inhabitant of their
respective counties, and also of all the slaves, free
negroes and mulattoes therein-distinguishing the
number of each class and the number of males and
females in each class-commencing on the first day
of April, 1860; and make a correct return thereof
to the Secretary of State on or before the first
day of October, -1860, which shall include the
number of free white males and females; and the
said assessor shall receive therefor three cents for
each person so enumerated, on the certificate of the
Secretary of State to the Auditor of Public Ac-
counts, who shall issue his warrant for the same.
SEc. 2. Be it further enacted, That each as-
sessor, before he enters upon the duties of his office
required by this act, shall take and subscribe the
following oath or affirniation before some person
authorized to administer the same: I do swear or
affirm (as the case may be) that I will take the
census of the county of - according to law;
and the said assessors are hereby authorized to
administer to persons giving in their enumeration
list the following oath, to-wit: You do swear
that the enumeration which you now render con-
tains a correct list of all the firee white inhabitants
of which your family consists; and if any person
shall refuse to make a due return of his or her
family, or any part thereof, he or she shall be fined
in the sum of twenty dollars, to be sued for and
recovered by the assessor before any justice of the
peace for said county; and being so recovered by
said assessov, shall be by him paid into the county
treasury of the county of which he may be assessor,
for the use of common schools of said county;
and the said assessors are hereby required to desig-
nate in their returns the free white inhabitants of
