CHAPTER LXII.
AN ACT to punish negroes, and mulattoes, for rape or an
attempt to commit a rape.
SECTION 1. Be it enacted by the Legislature of
the State of Mississippi, That if any negro or mu-
latto shall commit or attempt to commit a rape on
any negro or mulatto female child under the age of
twelve years, such negro or mulatto, on conviction
thereof before any court having jurisdiction of
such offences, shall receive any number of lashes
on his bare back, not exceeding one hundred, on
each day, for five successive days, or suffer death
as the jury may determino; Provided, that the Cir-
cuit Court alone shall have jurisdiction'in all such
cases.                                       4
SEc. 2. Be it further enacted, That this act
shall take effect and be in force from and after its
passage.

CHAPTER LXIII.
AN ACT to confirm and amend the Charter of Incorpora-
tion of the Town of Rodney, in the State of Mississippi.
Of charter  SECTION 1. Be it enacted by the Legislature
of the State of Mississippi, That the charter
of incorporation of the town of Rodney in the
State of Mississippi, approved by the Governor of
the State of Mississippi, June 2nd, 1859, certified
by the Attorney General and, recorded in the book
of incorporations in the office of the Secretary of
State, be, and the same is hereby confirmed in all
things, and shall have the same force and effect as
if the same had been enacted in the first instance
by the Legislature and approved by the Governor
of the State.
SEc. 2. Be it further enacted, That the south-
