AN ACT to compel persons who may take up Runaway Slaves in this State, to deliver such slave or slaves, to the proper owner, agent or overseer, authorized to receive said slave or slaves, provided when said slave or slaves so captured, or taken up, (be nearer the residence of the owner, agent or overseer, properly authorized to receive said slave or slaves,) than to the county jail of said county, in which said slave may he taken up. SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That hereafter, whenever, any person or persons, who are authorized by law to capture runaway slaves, shall capture any slave or slaves, the property of any person in this State, that he or they, shall be compelled to take said slave or slaves so captured, and deliver said slave or slaves so captured, to the proper owner, agent or overseer, .provided said captured slave or slaves, when cap- tured, be nearer the residence of the owner, agent or overseer, than to the county county jail; the dis- tance to'becomputed by the nearest route, and that upon the delivery of said slave or slaves so taken up; that the owner, agent or overseer, shall be com- pelled to pay to the taker up, six dollars for each and every slave so captured, and upon a refusal, after delivery and demand, to pay over the sum of six dollars by the owner, agent or overseer, then it shall be the duty of the taker up to proceed to the county jail, and upon affidavit and proof, that said demand 'was made upon the delivery of said slave or slaves, then the jailor of the county shall receive said slave or slaves, and the taker up shall, after due proof aforesaid, receive the sum of ten dollars for each and every slave, as contemplated by the pro- visions of this act. SEc. 2. Be it further enacted, That if any person taking up any slave or slaves, shall refuse to comply with the provisions fully, as set forth in the first sec- tion of this act, said person or persons shall forfeit the sum of reward for said capture, and also be held liable to damages to the party agrieved. SEc. 3. And be it further enacted, That this act shall take effect and be in force from and after its passage. Approved March 4. 1850. 229
