and any law conflicting with the provisions of this
act be, and the same is hereby repealed.
SEC. 3. Be it further enacted, That it shall be
the duty of the commissioners, to be elected, under
the provisions of this act, to take from the contractor
or contractors, for the building of said asylum, bond,
with good and sufficient security, payable to the
Governor of the State of Mississippi, and his suc-
cessors in office, in a penalty of double the amount
of his contract, conditioned for the faithful perform-
ance of his contract within two years after the pas-
sage of this act.
SEc. 4. Be it further enacted, That it shall be the
duty of the commissioners to advertise in the two
Toadver- newspapers printed in the city of Jackson, for the
tise.   period of six weeks, that sealed proposals, for the ex-
ecution of the work to be done in the completion of
said building, will be received by them for doing
said work, or any part thereof, and they shall give
the preference, in making any such contract, to the
lowest bidder who can give good and sufficient bond
and security for his performance: Provided, that
nothing in this section shall be so construed as to in-
terfere with any contract heretofore made by the
commissioners appointed by the law of 1848.
SEc. 5. Be it further enacted, That in case of
Vacancy. death or resignation, of either of said commissioners,
in the absence of the Legislature, His Excellency,
the Governor, be empowered to fill such vacancy.
SEc. 6. And be it further enacted, That this
act shall take effect and be in force from and after
its passage.

SECTION 1. Be it enacted by the Legislature oj
the State of Mississippi, That hereafter, the respec-

cery courts prescribed by law, shall in law be considered and re-
garded as always open : Provided, that nothing
herein contained shall be so construed as to prevent
the regular terms of said courts as now prescribed
by law.
