SEc. 2. Be it further enacted, That in all cases,

commence or. sustain an action, either at law, or in

son tort, and such creditor may recover in such
action at law, or in equity, as the case may be, upon
his claim, debt, or demand, if properly established,
without the necessity of a previous judgment
against such executor, de son tort, or his executor
or administrator, on such claim, debt, or demand.
SEc. 3. And be it further enacted, That this act
shall take effect and be in force from and after its
passage.

CHAPTER 35.
AN ACT concerning costs of prosecutions of slaves for minor
offences.
SECTION 1. Be it enacted by the Legislature of
the State of Mississippi, That in all prosecutions of
slaves before any justice of the peace, for any
offence punishable with stripes only, the prosecutor,
or prosecutors, shall be taxed with all costs of such
prosecution, unless it shall appear, by evidence on
the trial of said cause, that the master, owner, or
overseer of such slave, had been informed of the
offence charged to have been committed by such
slave, or slaves, and had neglected or refused to
give or administer reasonable correction therefor;
and if it shall appear on such trial that the master,
owner, or overseer of the accused slave, or slaves,
had been so informed, and has neglected or re-
fused to administer such reasonable correction,
then, and in that case, such master, owner,
or overseer, shall be taxed with the costs of
