CHAPTER 5.
AN ACT to amend an act entitled an act to change the mode of
collecting revenue of Hawkers and Pedlars, approved February
28, 1846.  -
SECTION 1. Be it enacted by the Legislature of the
State of Mississippi, That the second section of the
above recited act be, and the same is hereby Yepealed,
Rate of and that hereafter the following rates shall be paid
license.  for license to hawk and peddle in any county in this
State, to-wit: For license to carry merchandise on
foot, one hundred dollars; for license to carry mer-
chandise on horse, or other beast of burthen, one
hundred and fifty dollars; and for license to carry
merchandise in a vehicle, or in any other manner
than as before mentioned, two hundred dollars.
SEc. 2. Be it further enacted, That if any person

without li. without first having obtained a license therefore, ac-
cense.  cording to the provisions of this act, and the act
hereby amended, he or they so offending, shall forfeit
and pay to the county treasury the sum of five hun-
dred dollars for each violation, which shall and may
be recovered in the name of the State of Mississippi,
and sued for in any court of this State, having juris-
diction thereof, one-fourth to be paid to the prosecu-
tor, or person sueing, and the balance into the county
treasury of the county where such offence may have
been committed, for common school purposes.
SEc. 3. Be it further enacted, That all hawkers
To exhibit and pedlars shall be bound to exhibit their license
license.  (when thereto requested) to any freeholder of the
county in which lie may be hawking and pedling,
and any hawker or pedlar who shall refuse so to do,
shall on due proof theriof, made to any justice of the
peace of such county, be subject to a fine of not less
than twenty, nor more than fifty dollars, one-half to
be paid to the informer, and the other half into the
county treasury for common school purposes, and
each and every justice of the peace of any county in
this State, is hereby required, upon oath being made
before him, by any citizen of any such county, that
such hawker or pedlar has refused to exhibit his
license as above required, to forthwith issue his war-
rant for the arrest of any such hawker or pedlar, and
cause him to be brought before him forthwith, or
some other justice of the peace of said county, and
