Sec. 11. Be it also enacted, That the said'

See. 1. Be it cnacted by the Scnate and House of Representa-
tives of the State of Mississippi, in gcneral assembly convened,
That the fifty-second section of an act, passed 18th
June, 1S2, entitled 6an. act, to reduce into one,
the several acts, concerning slaves, free negroes)
Construe. and mu)attoes-when the killing does not actu-
tion ofthe ally occur, shall be so construed as to render the
act of June         .
±822.   proof of malice aforethought express, to subject
the person or persons therein named, to capital
punishment, provided no proof of express malice
Proviso. shall be required vhen the assault and battery is
committed by a slave, upon his or her master,
