BE it enacted by the Ltgislative Council and House of 'Representatives of the Alississippi Territory, in General Assembly cownedc; That any slave may be tried lor any offence not capital, by any Justice of the o Peace on Warrant, and may be sentenctd to not cipi. receive any number of stripes, not exceeding ' one hundred, which sentene shall be eXcu. of peace ted by the Constable; Provided, however, ' I'* that no blave shall be seitenced to receive u sIUcctd more than thiry-niine lashes, unlebs two re- n11n spectableslae-holders, to be sunnoned by the Justice, for the purpose of trying said slave, concur wirh him in the sentence ; and any such Justice of the Peace shall sumnmon, and compel the attendance of nil Witinesses Tecessary to establish any fact, for or against suh slave, and shll iduly examine such Witnesses. Sec. 2. And be it further enacted, That three Justices of the Quorum, or two Jisticcs of the Quorum and one Justice of the Peace, in vnphI and in case there be no Justices of the Quo. Pcace shall hold a Court, at the Court-house of the County, for the trial of any slave Clerk o' charied ith a Capital offnce, and the superio' Clerk of the Superior Court of the County, in att which such Court may sit, shall attend it, &a. and make a record of its proceedings, and shall issue all necess ry subpoenas for such Slave, as wcll as for the Territory, to compel the attendance of Witnesses, and shall charge the usual fees to be paid by the Territory.
