That section three of an act entitled an act concerning perpetua- ting testimony, approved December 1, 1855, be and the same is hereby amended to read as follows: § 3. The commission shall be issued by the clerk of the county in which the judges granting the same preside, and being witnessed by the clerk and the seal of his court shall be directed to any judge, justice of the peace, notary public or clerk of any court of record being in the county where such testimony is, to be taken, requiring such judge, justice, notary public or clerk to take the depositions of the witnesses therein named. .§ 2. Said original section three is hereby repealed. § 3. This act to take effect and be in force from and after its passage. Approved February 17, 1865. MISCELLANEOUS: POLL TAX. AN ACT exempting certain persons from the payment of a poll tax. 1. Persons wounded in the militia service I § 2. Any such person to make satisfactory to be exempt. proof, to whom. Re it enacted by the General ./ssembly of the State of Missouri, as follows: § 1. Every person who has at any time during the present civil war received wounds, or been otherwise injured while in the militia service of the State, in such manner and to such extent as would entitle him to a pen- sion, under the laws of the national government, had such wounds or in- juries been received while in the military service of the United States, is hereby exempted from the payment of a poll tax. § 2. Any person claiming the benefit of the foregoing section of this act shall make satisfactory proof to the assessor of the county, city or 69
