road passes, in proportion to the number of miles said road runs through
each county.
§ 8. That where this act does not conflict, it shall, in all respects, be
governed by the general road law now in operation in said counties through
which said road runs.
This act to be in force from and after its passage.

AN ACT for opening and repairing Roads and Highways in the county of Daviess.

* 1. County roads to be opened and repaired
in accordance with this act.
2. County Court authorized to enforce its
orders, as to establishing, opening,
or altering roads.
3. As to width of county roads.
4. Roads to be cleared of limbs; stumps to
be of certain heighth; streams to be
bridged, &c.
5. As to application to County Court for
new roads.
6. Notice of application to Court for road
to be advertised.
7. County Court to hear remonstrance
against any proposed road; Court to
appoint Commissioners. -
3. Commissioners tobe notified of appoint-
ment; how, and by whom.
9. Sheriff to make return as to notifying
Commissioners.
10. Of the duty of Commissioners; to take
oath, &c.
11. Commissioners to certify proceedings
to County Court.
12. Commissioners to assess damages for
right of way.
13. Persons objecting to giving right of
way to be summoned by Sheriff.
14. Purport of the summons referred to in
preceding section; said summons to
be served ten days before day of ap-
pearance ; as to the mode of service.
15. Further provisions in reference to dam-
ages, where parties have failed to
agree with Commissioners.
16. Further provisions on same subject.
17. Person wishing to change road may
petition Court therefor.
18. Court to appoint Commissioners upon
the subject of the petition spoken of
in preceding section.
19. Commissioners to report to Court; duty
of Court thereupon.
20. Application for change of road not to
be considered by Court unless certain
notice of said application shall have
been given.
21. As to applications that may be made
for vacation of road.
22. As to proceedings of Court upon such
application.

25. County Court to lay off road districts.
26. County Court to appoint Justice of the
Peace in each road district to lay
same off into sections; said Justice
to make report of his proceedings to
County Court; Justice to allot hands.

pointment of Justice, as above pro-
vided.
28. Sheriff to deliver to Justice said ap-
pointment within ten days.
29. Allotting Justices exempt from working
on roads.
30. County Court to appoint road overseer;
his term of service.
31. Said overseer to be notified of his ap-
pointment; how.
32. Allotting Justice to furnish a list of
hands to overseer; as to allotting
hands by Justice.
33. Allotting Justice to make return of al-
lotment to Clerk of County Court, to
be filed.
34. Justice may alter road sections, and
re-allot hands.
35. Term of service of Allotting Justice,
,   as such.
36. Road Overseer may purchase plow and
scraper.
37. How, and by whom said utensils to be
paid for.
38. Compensation of road overseer.
39. Who subject to work on roads.
40. Authority of overseer as to calling out
hands.
41. As to form of notice to be given by
overseer.
42. Penalty on hand for not attending, or
for attending and failing to discharge
his duty.
43. Delinquents to be placed by overseer
in the hands of a Justice of the
Peace.
44. Proceedings by the Justice in such ca-
ses.
45. Further provisions as to proceedings
by said Justice.
46. Allowance to be made to person furn-
