That the provisions of an act of the General Assembly of the State of Missouri entitled an act concerning swamp and overflowed lands in the county of Benton, in the State of Missouri. approved March 14, 1859, be, and the same iP hereby, declared to apply to and be in force in the counties of Bates and Henry, the word Benton in said act being changed to that of Bates and Henry wherever it occurs in said act,.so far as the purposes of this act are concerned. This act to be in force from and after its passage. Approved December 31, 1859. AN ACT to legalize the Acts of Robert L. Duncan, Surveyor of Bates County. Be it enacted by the General .Issembly of the State of Missouri, as follows: § 1. That the acts and ourveys made and done by Robert L. Duncan, and also of his deputies, as the Surveyor of the county of Bates, in the State of Missouri, be, and the same are hereby, legalized and made valid, in the same manner and with like effect as if the bond and commission of the said Duncan had been filed and recorded as required by law. This act to be in force from and after its passage. Approved January 16, 1860. BOONE. AN ACT to authorize the Inhabitants of the Town of Providence to elect a Recorder, and to prescribe his jurisdiction. Be it enacted by the General assembly of the State of Missouri, as follows: § 1. That at the time and place, and for the same period of service of that of a Trustee, there shall be elected, by the qualified voters of the town of Providence, in Boone county, a Recorder, who shall possess the same qualifications as to eligibility as any Trustee. The Recorder shall have jurisdiction throughout the corporate limits of the town. He shall be a conservator of the peace ; shall have all the powers and jurisdiction now vested in Justices of the Peace, and shall receive the same fees for his services. § 2. The Recorder, as well as the Justices of the Peace residing within the town, shall have concurrent jurisdiction in all civil cases and in all crim- inal proceedings instituted under any statute of this State. The Recorder shall have exclusive jurisdiqtion in all actions for the recovery of fines and forfeitures and for breach or trespass of any ordinance passed by the au- thority of said town: Provided, That in the absence of the Recorder any Justice of the Peace may act. 30 465 COUNTIES.
