Force and effect of the title as herein 2. Provisions as to paseing title to slave directed to be nade. so sold. 4. Disposition to be uade of proceeds of said slave, WHIEREAs, Richard D. Austin, of Monroe county, in the State of Missouri, by deed of gift, dated the 20th day of October, 1851, and recorded among the land record books of said county, in book L., on page 142, conveyed to Oliver P. Gentry, of the same county and State, a certain negro girl named Octavia, then aged about ten years, and any increase which she might thereafter have, upon the following trust, that is to say, in trust for the sole atid separate use and support of his daughter, Mary Ann Baskett, for and during the natural life of the said Mary Ann, free from the claim, acts or dominion of her present or any future husband, or any person claiming by, through or under them, whether as purchaser, creditor or otherwise ; and permitting the said Mary Ann to have the possession of said girl and any increase ; and at the death of the said' Mary Ann, said negro girl and her increase to be relieved of said trust, and pass out of said trustee, his heirs and assigns, and vest in, and pass to, the bodily heirs of the said Mary Ann forever, in equal parts ; therefore, Be it enacted by the General q1ssembly of the State of Missouri, as folows: § 1. That Oliver P. Gentry be, and he is hereby, authorized and empow- ered, with the assent of the said Richard D. Austin, Mary Ann Baskett and William B. Baskett, to sell said negro girl Octavia, and her increase, for cash, or upon a credit, as to him may seem best for the parties interested. D r. That upon such sale and payment of the purchase money to Richard D. Austin, the said Gentry, Austin, William B. and Mary Ann Baskett, shall execute and deliver to the purchaser a bill of sale of said negro girl, and her increase, reciting the sale by said Gentry, and receipt of the pur- chase money by said Austin, and conveying to the purchaser all the right, title and interest, both at law and in equity, which the said Gentry and the said Mary Ann Baskett, and those who would be the bodily heirs of the said Mary Ann Baskett, at her death, have or would have in said negro girl, and her increase, which bill of sale shall be acknowledged by said Gentry, Aus- tin, Win. B. Baskett and Mary Ann Baskett, and recorded among the land record books of Monroe county, in the same manner that conveyances of real estate are by law required to be acknowledged and recorded. § 3. That said bill of sale, when so acknowledged and recorded, shall be evidence of the assent of the parties thereto to the sale hereby authorized; and of the receipt of the purchase money therein stated to be received by the said Austin, in trust for the purposes hereinafter mentioned; and shall have the effect of conveying all the right, title and interest, both at law and in equity, which the said Oliver P. Gentry and Mary Ann Baskett now have, or the bodily heirs of the said Mary Ann Baskett would have in and to said negro girl, at the death of the said Mary Ann Baskett, and of any and every other person claiming by, through or under the deed of gift referred to in the preamble to this act ; and shall release Oliver P. Gentry of the trust created by the deed of gift referred to in the preamble ; and release the 104 MNOnS.
