Drake, of Carroll county, Mo., be, and he is hereby, authorized and empowered to sell the real estate belonging to James William Drake, Benjamin F. Drake, and Mary Thomas Drake, (minor heirs at law of Thomas V. Drake, deceased,) situated in Carroll county, Missouri, and described as follows, to wit : Eighty acres, being west half of south-east quarter of section unmlber one ; eighty aires, being west half of south-west fourth of section number two ; eighty acres, being cast half of south-east quarter of section number three ; forty acres, being north-west fourth of north-east quarter of section number ten ; twenty acres, being north half of north-east fourth of south-east fourth of section number eleven ; forty acres, being north-east fourth of north-east fourth of section number ten; thirty acres, being north part of north-west fourth of north-west fourth of section number eleven ; thirty acres, leing north part of north-cast fourth of north-west fourth of section number eleven ; forty acres, being north-west fourth of south-west fourth of section number twelve; forty acres, being north-east fourth of south-west fourti of section i umber twelve; forty acres, being north-west fourth of' south-east fourth of section number twelve, all inl township num b.er fifty- two, of rango mnumber twenty-three, nd containing in all live hundred and twenty acres, more or less. Said James E. Drake may sell ill or any part thereof, either for cash or upon such reasonable credit as lie may duem proper, and at such time as lie may think fit. § 2. Before any such sale so made shall Ie biinig, said James E. Drake shall report the same to the County Court of Carroll coimmty, Mis- soulri, or other court of said county having charge off guardians and mjinors, which said report and sale shall be ratilied anl confirmed by said court, and if approved by said court, said Jnes E. Drake shall further give bond with security, to be approved by said court, in a sum suflicient to secure the pro- ceeds of said sale; and if said sale be not approved by said court, or if said bond and security be not given by the said James E. Drake, then said sale shall be null and void. § 3. Whenever any such sale may he effected as above stated, said James E. Drake shall hold and have charge of the proceeds of said sale in the character and capacity of giiarilian anil curator of said minor heirs of said Thomas W. Drake ; and shall amilillister, loan out, and account for said funds, uder the direction of said court, in the same manner and with the like effect us other guardians and curators may or shall do ; and upon the ratification of said sale, as above provided for, said James E. Drake shall make to the purchaser or pirchasers thereof, a good and sufficient ded in fee simple, which shall be binding and eflectual for the purpose of transfer- ring the legal and equitable title to said real estate from said minors to said purchasers.
