CHAP. 127.

by the Constitution, to grant pardons, he may grant the same
with subi conditions, and under such restrictions, as he may
think proper.
SEC. 25.-Any person may be prosecuted, tried and pun-
ished, for any offence punishable with death, or by imprison-
ment in the penitentiary during life, at any time after the
offence shall be committed.
SEC. 26.-No person Shall be tried, prosecuted or pun-
ished, for any felony other than as specified in the last sec-
tion, unless an indictment for such offence be found within
three years after the commission of the offence.
SEc. 27.-No person shall be prosecuted, tried or pun-
ished, for any offence other than felony, or for any fine or
forfeiture, unless the indictment be found on a prosecution
instituted within one year after the commission of the offence,
or incurring the fine or forfeiture.
SEO. 28.-Nothing contained in the two preceding sec.
tions shall avail any person who Shall lice from justice; and,
in all cases, the time during which any defendant shall not
have been an inhabitant of, or usually resident within, this
State, shall not constitute any part of the limitation prescribed
in the preceding sections.
SEc. 29.-Where any illnictavent or prosecution shall be
quashed, set aside or reversed, the time during which the
same was pending shall not be computed as part of the time
of the limitation prescribed for the offence. (a)
