all additional sums above two thousand dollars, three per centum, with
such additional allowance for hiring out slaves, leasing real estate, and
collecting and preserving the estate, as the county or probate court
shall deem reasonable.
§ 2. So inch of the twenty-seventh section of the sixth article of
the act to which this is amendatory, as conflicts with the provisions of
this act, is hereby repesled.
This act slall take eflect and be in force from and after its passage.

FEES.
AN ACT to regulate the fees of the circuit attorney of the cighth ju-
dicial circuit.
Be itenacted by the General.6'ssembly of the state if Missouri, as follows:
§ 1. In lieu of the fees now allowed by law to the circuit attorney of
the eighth judicial circuit, he shall be allowed fees as follows: For his
services in each case of murder in the first degree, twenty dollars; for
his services in each case of rape, arson, burglary, robbery, forgery or
counterfeiting, ten dollars; for his services in each case of all other fe
lonies, eight dollars; for his services in all other cases, which by law it
is made his duty to prosecute or defend, four dollars; provided, that in
case defendant is not couvictcd, said attorney shall only receive one-
half of the amount of the fees above specified.
§ 2. The fees as above specified shall be taxed against the dvf'niJant
and collected as other costs in case of a conviction; but in cas- )f an
acquittal or the cause be otherwise disposed of, or the defendait oe in-
solvent, the fees as above specified shall be paid by the state ot County,
whichsoever may be liable by law to pay the same.
§ 3. This net to take effect and be in force from and after it 1assage.
