No county court, nor any other court in this State, shall grant a li- cense to any free neero, or person of color, to remain in this State, who shall not be entitled to a license to remain in this State, according to the provisions of this act. § 112. The county courts of this State shall have authority to grant a license to any free negro or person of color, who may be a native of this State, or who may have continued to reside in this State since the first day of January eigh- teen hundred and forty; provided, such free person of color shall enter into a bond to the State, with one or more securities, for his or her good behavior, in a penalty not exceeding one thousand dollars, conditioned that such free negro or person of color shall be of good belavior; and any crime, misdemeanor or violation of law shall be deemed a violation of the condition of said bond, and upon conviction, the license shall be forfeited, and the county court of the pro- per county shall cause such free negro, or person of color to be sent out of this State, at the cost and expense of such free negro or person of color, if he or she have the means, if not then at the cost of the State; provided, such free negro or person of color shall not be sent out of the State, until the punish- ment, which may be imposed upon such free person of color, shall have been satisfied; and provided further that this act shall apply to any free negroes, mulattoes or persons of color, coming into this State in any way whatever. § 13. It is h-oreby made the duty of Attorney General of this State and circuit attorneys in each circuit, to prosecute for all violations of this act, and for all penalties arising under the same. It is also made the duty of each con- stable and sheriff in this State, and the marshals of the city and county of St. Louis, to give information of all violations of this act. § 14. The provisions of' this act shall not exend to any free negro or person of color, who shall produce a certificate of citizenship of some one of the United States. Explanation of the seventh section of a former law, Be it enacted by the General Assembly of the State of Missouri, as follows: § 1. That the seventh section of the above recited act shall not be so con- strued, as to be applicable to free persons of color, who are entitled to reside in this State, according to the provisions of said act.
