§ 4. All such depositions shall be taken, certified and returned in all respects
as in cases at law, and being so taken, certilied and retirned, may be read in ov-
idence without proof of any of the facts specified in either of the sub-divisions of
the ninctcoth section of an act concerning depositions approved February 14th,
1835. except as in the next section specilied.
§ 5.  When the deposition of a witness re.siding in the county in which the
cause is pending siull have been taken, the nirty, in whose bhalf tbo same was
taken, may be required to produce and examine the witnesses in open court, or
show cause to the contrary, by notice 1in writing to that effect.
§ 6.  If such notice shall be duly served ten days before the trial, the deposi-
tion of the witness in the notice named shall not be received in evidence, unless
one or more of the fhets specilled in the nineteenth section of the above recited
act concerning depositions be established to the satisfction of the court.
This act shall take effict from and after its passage.

PUBLIC WORSIIP.
AJY ACT for the more ye'ltual protection of    Public Worship in the State of
Missouri.
Sc. 1.  'The erection of stall, tents &c., for the purpos  of selling- liquors &.c., forbiddei within  two
miles of any place of religious worship.
2.  Penalty for the violation of this art.
:. Tavern keepers, merchants anl venduers of bread &c., not affected by thisact.
4.  Punishment of any  negro, Indian, or inlatto  found  sell! i. liquors &c., within the forbidden
limits.
5. Penalty for dinrrbig any religions WOVshiip by unultuous noises.
Be it enacted by the General .-ssenzbly of the State of Missouri, as follows:
§ 1.   From   and after the passage of this act, it shall not be lawful for
any pisonor persons, to erect, )lace or have [anly] booth, stall,tent, carriage, boat
vessel or other vehicle or contrivance for the purpose or useof selling,giving,or
otherwise disposing of spirituous liquors, wine, porter, beer, cider,orothier fermen-
ted or mixed strong drink, or other article of traflic, within two miles of any
camp meeting or other place of religious worship during the time of holding
any meeting for religious worship at such place, excepting as herein after ex-
cepted.
§ 2. If any person or persons do, or shall violate the provisions of this act,
by selling, giving, bartering or otherwise disposing of spirituous liquors, wine,
porter, beer, cider, or other mixed or fermented strong drink, or other article of
traffic, within two miles of any such place of religious worship, during the, time
of holding any meeting for the purpose of public worship at such; the person so
offending shall first be informed of his, her or their violation of this act by any
house holder in said county, and warned to desist therefrom, and if the person so
offending shall forthwith cease to violate this act, no further proceedings shall be
had; but if such person or persons shall refuse or neglect immediately to desist, or
remove at least two miles from such place of worship, after being so warned, on
conviction before a justice of the peace of the county in which said offence is
committed, shall forfeit to the county, for the use of common schools, all such
liquors, wines, beer, cider or other strong drink, or other articles of iradic, offer-
