District Attorney SEu. 70.5 Be it further enacted, c&c., That the several District
nt Attorneys throughout the State shall be entitled to demand and re-
ceive one-fifth of all sums, first deducting the per contage allowed by
lhw to the Sheriff for and paying over the same, which may be col-
lected on forfeited bonds,. recognizances, and fines imposed in criminal
proscoutions and misdemoanors, by any court of justice.
Fines paid to city SEC. 71. Be it ftrther enacted, ctx., That the fines alid forfe -
instead of State. tures collected for violation of the criminal laws of the State, and
which have been required by law to be paid into the State Treasury,
shall belong and be .paid into the treasury of the parish in which they
may be collected, and in New Orleans into the treasury of the city.
This section shall not be so construed as to affect in any manner
the process for collecting fines and forfeitures.
Costs paid by ac- SEC. 72. Be itfurther enacted, 4o., That whenever a complaint
ad-by compla shall be made before a Justice of the Peace, or the Recorder of either
District of the city of New Orleans, the object of which will be to
have the person complained of bound to keep the peace, the costs
incurred shall be paid by the person bound; but when it shall appear
to the magistrate that the coniplaint is founded on frivolous or mali-
cious motives, the costs shall be paid by the party complaining. .
Repealingdclause. SEc. 73. Be it further enacted, cc., That all laws contrary to
the provisions of this Act, and all laws upon thd same subject-matter,
except the thirty-third section of an Act entitled an Act for the
punishment of crimes and misdemeanors, approved May fourth,
eighteen hundred and eight, and except what is contained in the Civil
Code and Code of Practice be repealed.
