Be it enacted by the Senate and House oJ Repre- sentatires of the State of Louisiana in General Assembly con- iughts of riparia rcned, That whenever the riparian owner of any property in the in- and toClue corporated towns or cities in this Statc, is entitled to the right of ac- cretion, and batture has been formed in front of his land, more than is necessary for public use, which the corporation withholds from him, he shall have the right to institate suit against the corporation for so tutch of the batture as may not be necessary for public use, and if it be determined by the court that any partion of it be not necessary for public use, it shall decree that the owner is entitled to the property, and shall compel the corporation to permit him to enjoy the use and ownership of such portion of it. certaln laws re. Be it further entacted, dc., That all laws or parts of 5'J laws conflicting with the provisions of this Act, and all laws on the samre subject-matter, except what is contained in the Civil Code and Code of Practice, e repealed. Be it enacted by the Srnate and Hfous of Repre- sentatires of the State of Louisiana i1t General Assembly con. slaves ecsed of tened, That such slaves as may be accused of capital crimes in the -aptal offences, by parish of Orleans shall be tried by a tribunal composed of the Judge ,whom Wied of the First District Court of New Orleans and six citizens, slavc- holders in said parish, chosen and convoked by said Judge. Oath to be takenb SEc. 2. Be it further enacted, &c., That the Judge presiding the Judge. shiall take the following ot . 1, A. B., do solettnly swear or affirm, (as the case may be,) that I will truly and impartially examine aid judge the prisoner (or prisoners) who may be brought before me ac- cording to law and the evidence to the best of my knowledge or ability. Be it further enacted, &r., That in order to conviet the required. accused, the jury must unanimously concur in a verdict to be by them signed, on which verdict the Judge shall endorse the sentence.
