Be it enacted by the Senate anl Housc of -Representatives of the State of Louisiana, in Generat Assembly convened, That from and after the first day of May next, it shall not be lawful for any pedlar, or hawk- er, to sell, barter, or exchange any description of goods, wares, or mer- chandise, on any of the water-courses or highweys of this State, except after having obtained a license, as herein provided. Sec. 2. Arul be it further enacted, That it shall be the duty of every person, wishing to sell or barter, as stated in the first section of this act, to pay in the. State Treasury as follows: for every cart, or carriage, of whatever description, twenty dollars; for every boat or water craft, of whatever description, seventy-five dollars; for every person carrying goods on horses, as well as for every person carrying goods and merchan- dise in packs, five dollars; on the receipt of whici it shall be the duty of the Treasurer of the State, to grant to such persons a licence to sell, barter, or exchange, during one year, w ithin the limits of this State. Sac. S. And be it further chacted, That it shall be the duty of every pedlar, or hawker, before commencing any species of traffick or trade, in this State, to cause to be affixed to the water-craft, or vehicle, of whate- ver description, in which his or her goods may be transported, a label,. bearing the name of the parish of his or her domicil, and bearing also the number of his or her boat or vehicle, as aforesaid, and it shall be the duty of the State Treasurer, to insert in each license the name, domicil, and number of every person receiving a license by virtue of this act, and also to keep a record of the same, according to the order of number and date. SEc. 4. And be it further enacted, That all pedlars and hawkers shall be bound to exhibit their license, (when thereto required,) to any free- holder of this State, and any person who shall act contrary to, or in vio- lation of any of the provisions of this act, shall, on due conviction there- of, before any Court of competent jurisdiction, be fined in a sum which shall not exceed five hundred dollars, or be less than fifty dollars, one half to the use of the State, and the other half to the benefit of the informer, and be further liable to imprisonment for a term not to exceed three months, or be less than fifteen days. SEc. 5. Ad be it further enacted, That if any pedlar or hawker shall sell any species of spirituous liquors, arms, or ammunition whatever, to any negro; or if any such trader shall purchase any poultry stock, or article of any description, from any slave, without the consent of his mas- ter, mistress, or oversecr of said slave, such pedlar, or hawker, on con- viction of the same, before any Court of competent jurisdiction, shall be rendered thereby incapable of receiving a license thereafter, and forfeit all goodsand chattels found in his possession, one half to the State, and one half to the informer. SEc. 6. And be it further cuacted, That whenever it shall appear upon proper affidavit, to the satisfaction of any Judge, or Justice of the Peace, that any of the foregoing provisions have been contravened or violated. it shall thereupon be the duty of the Judge or Justice of the Peace before whom the complaint is made, to issue a writ of attachment, com- manding the Sheriff of his parish, or any Constable therein, to attach or seize any and all carts, carriages, boats, or water-crafts, belonging to, or which may be found in the possession of the pedlar or hawker complained of, together with all goods, wares, and merchandieze found therein, and the same safely in his possession keep, in order to abide the decision of
