bruary, eighteen hun tred aod fif .en, in all cases of failui e
or insolvency of any deb-or of the stfte, :nd in all cases
when the property rein  giif in the haids of any executor,
administrator or syodic shall not 1-e suflicient for the piy-
ment of all the debts of the deceased 'or banirupt, the debt
due to the stIsc satll be piid by jrivilege mnd preference to
any other; and cvery executor, adminitrator or syndic, wo.
shill ksowing'y pay other deb:s of the deucased or bank-
rupt before those due to the state, shall be personally res-
ponsible aw also his personal estate for the paymenit of what-
ever srn may be due to the stmae by the deceased or bank-
rupt ; but this act shall in no manner impair the conventiqp-
al, legs) or judiciarv mor!gages which may have been ob-
tained by any individual or the state on the prope rty of the
deceasrd  r bankropt, prior to the time when the bond dfI
such officer was givcn i.n recorded.
