collected and paid into the treasury: Provided, That
nothing herein shall he held to prevent parties from rely-
ing upon the statute of limitation, and the other defenses
applaic:hle by existing laws to like actions.
§3. That the said Agent of the Auditor have full power

onc -& L proof of their justice and correctness; and ma, when in
his judgment the interest of the State will be best promot-
ed, coinpound and settle any of such balh aces, though it
be for a less sum than the whole amount owing; but in all
such settlements a full statement of the same shall he filed
-with the Auditor, signed by the said ager.t; and upon the
filing of such statement, and payment into the treasury of
the amount agreed upon, the Auditor ,hall balance and
close the account, s) settled, on the hooks in the Auditor's

§ 4. That the compensation of' the Agent of the A uditor,
