§ 9. That if any person shall, without lawful authority,  1860.

offending shall be liable to an indictment by the grand jury

offending shall also be liable to the corporation, or any per-
son injured, in an action for damages, which, when recover-
ed, shall be applied by the corporation to restore, as far as
possible, any injury that has been done.

should any person violate this section, for the first offense
he shall be fined the sum of one dollar, and for the second
and each succeeding offense five dollars, to be recovered
before any justice of the peace in the name of the Com-
monwealth of Kentucky, for the use and benefit of said
corporation, the proceeds of which shall be applied to the
use of said corporation.
§ 11. No one but a member of this corporation shall be
eligible to the office of trustee of the same.
§ 12. This act shall take effect from its passage.

AN ACT to amend the charter of the town of Hodgenville.
Be it enacted by the General Assembly of the Comnmonwealth
of Kentucky :
