shall pay over the same to the Trustees of said town,
who shall faithfully expend said tax as provided for here-
in; and said Trustees shall report, annually, to the Green-
up County Court, at its Court of Claims, the amount of
tax raised, the amount paid out as provided for herein,
and to whom, which report shall be first sworn to by said
Trustees.
§ 4. If at the end of any year there shall be a balance  Surplus to be

Common School District, to be held and expended by said
last named Trustees in the erection, completion, and fur-
nishing of a suitable school house for common school pur-
poses in said district.
§ 5. Nothing in this act shall prevent any tax payer,
residing in Ashland, from working out the amount of his
tax upon the streets of said town in the same manner as
he is now authorized by law to do on any portion of the
roads in his district.

CHAPTER 339.
AN ACT to amend and reduce into one, the several acts in relation to the
town of Hopkinsville.
Be it enacted by the Gencral Assembly of the Commonwealth
of Kentucky :
§ 1. That the following boundary is hereby declared to  Boundaryof
be the limits of the town of Hopkinsville, to-wit: Be- town.
ginning at the southern abutment of the bridge on the
Madisonville road; thence south 68 degrees, east 172
poles, to a stake in D. S. Hay's field; thence south 22 de-
grees, west 240 poles, to a stake in F. C. Sharp's field;
thence north 68 degrees, vest 236 poles, to a stake in W.
T. Smith's lot; thence north 22 degrees, east about 80
poles, to the river; thence up the same, with the several
meanders thereof, to the beginning.
§ 2. That the fiscal, prudential,and municipal concerns Trustees.

shall be vested in seven Trustees, four of whom shall
form a quorum to transact business, and all of whom
shall have resided in said town one year next preceeding
their election, and be housekeepers therein.
