1858.      § 6. The Board of Trustees shall have power and an-

streets & alleys kept open, clean and in repair. They may, by their or-

pavements or sidewalks, and plant shade trees in front
of their respective lots, and enforce the same by their by-
laws and appropriate penalties thereunder. They may
also construct roads or wharves from the streets in said
town to the water's edge in the Ohio river.
§ 7. They may also appoint such other inferior officers,

CHAPTER 287.
AN ACT authorizing the County Judge of Ohio county to submit to the
qualified voters of said county the propriety of voting a tax for road pur-
poses.
Be it enacted by the General Assembly of the Commonwealth
of Kentucky:
That the County Judge of Ohio county may, by order
entered on the books of his court, submit to the qualified
voters of said county, at the next general August election
in 1858, whether they will tax themselves to the amount
of seventy-five cents on the head of each person and
slave who, by law, is now compelled to work the roads;
and if the tax is so voted those who, by law, are com-
pelled to work shall pay to their overseers said sums on
demand, unless they prefer to work, and on their failure
to do the one or the other they shall be subjected in man-
ner and form to the penalties now denounced by law on
their failing to work. The Sheriff is hereby directed, un-
der the penalty of twenty dollars, to be recovered by in-
dictment or presentment in the Circuit Court, for each of-
fense, to stick up one notice in each voting district of said
county, specifying the object of the vote. The Clerks of
the different election precincts, under like penalties in
last preceeding section, and recoverable in like manner,
shall open two columns, one for and one against the tax;
and the several Sheriffs shall propound to each voter,
are you for or against the tax? Which vote shall be re-
turned and compared as the returns for representatives
are now, by law, directed to be returned; and if a ma-
jority have voted for the tax this act shall immediately
take effect. The several overseers shall expend the sums
of money collected in the improvement of the roads.in
their respective districts, and shall report to the County
Courts, semi-annually, the amounts of money thus col-
