1847     said small tract of land is conducive, and would be to the per-
manent advantnge of said Eliza Jane Burks, it shall and may be
lawful for said court to decree a sale of said land, on such
terms and credit as the said court shall deem most proper:
Provided, That said court shall not decree a sale of said land
until satisfied by proof, to be made orally or by deposition, of
the truth of the statements of said petition, and that such sale
will be to the permanent welfare and advantage of said Eliza
Jane Burlis, and not contravene the will of said David Bran-
denburg; and said court shall cause a deed to lie made to the
purchaser of the land, by a Commissioner, agreeably -to the
usages of Courts of Chancery, upon the payment of the pur-
-hase money; whose deed, when approved by said court, shall
pass the title to the purchaser.

CHAPTER 506.
AN ACT for the benefit of Jines Filw, of Grtres county.
Be it enacted by the General Assembly of the Commoniwealth
of Kentucky, That the Register of the Land Office be and he is
hereby directed to issue a patent to James Fike, for the north
west quarter of section three, township Iur, range two, east,
without prejudice to the claim or claims of any one legally or
equitably entitled to the same-it appearing to this General
Assembly that the said Fike has entered 'he above described
quarter section of land, and lost or mislaid the certificate of
entry.

CIAPTER 507.
AN ACT for the benefit of John and Ilarricon Dobbs.
Be it enacted by the General Asse'nbly of the Commonwealth
of Kentucky, That Harrison Dobbs and John Dobb3 be and
they are heieby permitted to bring into this State a negro
matt named Joseph, about forty years of age, without incur.
ring any penalty therefor: Provided, That the said Dobb.
shalI, within thirty days from the day of importing said ne-
gro into this State, make affidavit, before some Justice of the
Peaco for Allen county, that they did not purchase said negro
for merchandise, but ibr their own use; which affidavit shall
be filed by the Clerk of the County Court of said county in
his office for safe keeping,
