Rice, Leander F. Bradshaw, Catharine Conn, (with her hus-  1847
band, Thomas Conn,) Malinda A. Wilson, (with her husband,
William P. Wilson,) Mary A. Holmes, (with her husband,
Robert J. Holmes,) Sarah A. Taylor, (with her husband, John
C. Taylor,) John Bradshaw, Matilda Bradshaw, Juriah Brad-
shaw, and Elijah Liter Bradshaw, devisees of John Bradshaw,
deceased, or such of them as may think proper to join as pe-
titioners, to file their petition in chancery in the Oldham Cir-
cuit Court, making those of said devisees who do not unite as
petitioners defendants to the proceeding, and praying for the
sale of the tract of land near Floydsburg, in Oldham county,
containing about four hundred and fifty six and one fourth
acres, devised by said deceased to said Catharine, his widow,
and to his heirs, and their bodily heirs. Such of the devisees
as are not petitioners may make such defence as they deem
proper, to show the sale prayed for would not redound to the
advantage of those interested. The parties may take proof
by depositions, and otherwise, as :Admissible in other chancery
proceedings, so that all the circumstances of the case may be
properly presented to the Chancellor, but without reference to
any division of said tract of land among the devisees hereto-
fore made. If the Chancellor be of opinion a sale of said land
would be to the advantage of said devisees, he shall order a
sale, on such credit as le may deem proper; and when all the
purchase money is paid, order a conveyance to the .purchaser,
his heirs or assigns; which conveyance, when approved by the
Court, shall vest the complete title in the grantee.
S~c. 2. The said Court shall make such order with respect
to one third of the purchase money, as shall cause the same to
be vested in other lands, the use %;hereof shall be to the said
Catharine Rice for life, with remainder to the other devisees
of said John Bradshaw, deceased, agreeably to the provisions
of his will; or the money may be loaned at interest, subject
to the same limitations; or if the parties agree, any other dis-
position thereof made, as may be to their advantage and just.
The portion of the proceeds of said sale belonging to the in-
fant parties shall be disposed of agreeably to the law now in
force authorizing the sale of infant's real estate, and the bal-
ance distributed to the proper owners according to their res-
pective interests.

WhILREAS, certain slaves, Meriman, Willis, Isabella, Fanny,
Joe, Old Hannah, Lavina, Richard, Venus, Jessica, Hannah,
Jenny, anti Rose, are held in trust for Sarah J. Cowling, wife
of John V. Cowling, in the State of Georgia, hand said Cow-
ling and wife came to Louisville, Kentucky, on a visit, but af-
