1847                          CHAPTER 3112.
AN ACT for the benefit of the heirs of Daniel Bnrksdale, decensed.
WnnrE',s, it is represented to the present General Assem-
bly, that Daniel Barksdale. deceased, late of Todd county,
Kentucky, departed this life several years since intestate, seiz-
ed and possessed of a valuable tract of land in said county of
Todd ; it is also represented that the heirs and legal represen-
tatives of said Barksdale are desirous to sell and convey said
tract of land, and one of said heirs, to-wit, Sally M. )avid-
son, being a hnatic and incal)able of consenting to said sale.
Therefore,
Be it enacted bi the General Assembly of the Commonwealth
o1 Kentuckq, That it shall be legal for any one or more of' the
heirs of' Daniel l1irksdale, deceased, to file their petition or
bill in chancery in the Todd Circuit Court, making all the heirs
and legal representatives of said larksdale parties thereto,
who shall be duly notified thereof, unless by answer they
waive said notice; and it shall be the duty of' said Court to
appoint a colmmittee for Sally L. I)avidson, a luatic, daugh-
ter of said Barksdale, deceased, which committee, so appoint-
ed, shall, in ali respects, represent the interest of said lunatic,
and answer for her without the service of process on her; and
he shall enter into bond, with good security before said Court,
in a penalty equal to double the value of the interest of said
lunatic, in said tract of land, paYaldC to said lunatic, and her
legal representatives, conditioned faithfulv to discharge the
duties imposed upon him by the decree relflered iu said suit;
and if from the ftcts and pleadings, all the circumstances con-
sidered, the Court shall be of opinion that the interest of said
heirs, and especially said Sally IM. Davidson, will he promoted
by the sale of said land, then said Court shall make a decree
ordering and directing the sfde of said land, on such a credit as
may be deemed reasonable; and directing said committee to
receive that portion of the proceeds of' said sale to which said
lunatic may he entitled. and hold thesame for the use and ben-
efit of said lunatic, and her legal representatives, subject to
anv future order of said Court. A Commissioner shall be ap-
poitnted to execute said decree, on dme notice, and muake con-
veyance of said land to the purchaser upon the payment of
the purchase money.

ton, a fiee woman of color, who stands indicted in the Adair
Circuit Court for house burning, to the county of Cumberland,
