CIIAPTER 174.
AN ACT for the benefit of Rebecca Morrison, and the heirs of Joseph A.
Morrison, deceased.
SEC. 1. Be it enacted by the General Assembl of the Coin-
monwealth of Kentucky, That it shall and may be lawful for
Rebecca Morrison, widow, devisee and executrix of Joseph A.
Morrison, deceased, to file her bill in chancery in the Adair
Circuit Court, making the children and devisees of the said
Joseph A. Morrison, deceased, parties thereto; and shall state
in said bill that it would be to the interest and advantage of
all the heirs to sell three tracts of land, or any two ns she may
think best, that the said Joseph A. Morrison died seized and
possessed, lying and being in Adair county; one tract contains
one hundred and eight and one third acres; one other tract of
ore hundred acres, and one other tract of about five hundred
acres, more or less; and shall file with said billa certified copy
of the will of said Joseph A. Morrison, deceased, and the
deeds or other evidences of title to tile lands proposed to be
sold; and when all the heirs shall be legally and properly be-
fore the Court, by themselves and their guardians ad litem, it
shall and may be lawful for said Court to decree a sale of said
tracts or parcels of land, set out and described in said bill, upon
such terms and credit as said Court shall deem most advisable:
Provided, Said Court shall be of opinion, from the evidence,
by proof made to the satisfaction of the Court, that it would
be to the interest and advantage of the devisees and heirs to
sell said tracts of land aloresaid, or any two of them: And,
.provided further, That all the adult heirs shall agree to the
sale.
Src. 2. That the said Rebecca Morrison, if she shall desire
it, shall also state in said bill that she is willing that two thirds
of the slaves of which the said Joseph A. Morrison died seized
and possessed, shall he divided among the heirs of said Joseph
A. Morrison, deceased ; she shall set out in said bill the names
and description of the slaves she may wish divided among tie
heirs, and it shall and may be lawful for said Court to decree
a division of said slaves among the heirs of said Joseph A.
Morrison,deceased; and the Court shall have power and au-
thority to make such order and decree in the case as shall be
necessary to accomplish that object and secure to the infant
heiri the slave or slaves allotted to them: Provided, Said Court
shall be of opinion, from the evidence, by proof made to the
satisfaction of the Court, Ihat it would be to the advantage of
