1847                           CHAPTER 51.
AN ACT for the benefit of Benjamin Payne, of the county of Daviess.
WimnrAS, it appears that Benjamin Payne, who emigrated
to the county of Daviess in the year 1845, from the State of
Maryland, was, at the time of his said emigration, and is' now,
tile owner of certain slaves, three in number; that the said
slaves are at thi's time in said State; that hie was ignorant, Qt
the time of his emigration, of the act of 1S33; that he has
purchased land and permanently located in this State; that he
cannot bring the slaves aforesaid to this State, without incur-
ring the penalties of the act, entitled, an act to amend the law
prohibiting the importation of slaves into this State, approved
February 2d, 1833. For remedy whereof,
Be it enacted by the General Assembly of the Comnonwealth
of Kentucky, That it shall be lawful for the said Benjamin
Payne to import into this State, for his own use, the slaves
aforesaid, to-wit, John, Jane and Rebecca: Provided, the
said Benjamin Payne shall, within thirty days after he imports
said slaves, take a,  oath before some Justice of the Peace, that
he was ignorant of tlie provisions of the act of 1833, above re-
cited; that he was the owner of said slaves beforo his said em-
igration, and ever since; that lie imported them for his own
use and not as merchandise; and have the said affidavit re-
corded in the County Court of Daviess county; and upon the
failure of said Payne to take said oath, and have the affidavit
thereof recorded as aforesaid, this act shall not be construed as
in any manner exempting him from the penalties of the act of
1833.

CHAPTER 52.
AN ACT for the benefit of William Smili, Clerk of tim Grant Circuit and
County Courts, and William 11. Evans, late Sheriff of Grant county.
Srec. 1. Be it enacted by the General Assembly of the Corn-
monwealth of Kentucky, That from and after the passage of
this act, William Smith, Clerk of the Circuit and County
Courts of Grant county, be and is hereby authorized to issue
his fee bills, as Clerk of said Courts, and list the same with the
proper officers, for the years 1840, 1841, 1842, 1843, 1844,
and 1845; who shall receive, collect, and account for the same,
as though the same lla( been listed in proper time; and the
said officers are hereby authorized to levy and distrain for such
fee bills, so issued, as tlhoigh the time allowed for distraining
had not expired: Provided, however, that tile said Smith shall
be subject to the same penalties for issuing illegal fee bills, un-
der the authority of this act, as lie would be in ordinary cases.
SEc. 2. Be it further enacted, That, from and after the
passage of this act, William H. Evans, late Sheriff of Grant
county, and his deputies, shall have the further time, until the
