1847     orally or by deposition or affidavit, shall be of opinion that a
sale of said tract of land would be to the interest and advan.
tage of the said Jane Berryman and her children, and that it
would be proper to vest the proceeds of the sale of said tract
of land in another tract of land, it shall and may be lawful for
said Court to decree a sale of said tract of land, upon such
terms and credit as said Court may deem proper, and that the
proceeds of such sale, be vested in the purchase of another
tract of land, for the sole use and benefit of said Jane Berry-
man, and her issue, to remain in the hands and under the man-
agement of said Trustee; and Lhe Court, in such decree, shall
appoint a Commissioner to make said sale, and to convey said
land to the purchaser, on tie payment of the purchase money;
which deed shai, be acknowledged and approved in open Court,
and shall be certified to the Clerk of the Ohio County Court
for record; said Court shall also appoint a Commissioner to
purchase and receive the conveyance of another tract of land,
to said Trustee, as contemnplaAed by this act.

AN ACT for the benefit of Beverly Megary, of Graves county.
Be it enacted by the General Assembly of the Commonwealth
f Kentucky, That the Register of the Land Office be and he

west, without prejudice to the claim or claims of any one le-
galiy or equitably entitled to the same, it appearing to the satis-
faction of this General Assembly that Greenberry M. New

said Megary, and placed by him (Megary,) in the hands of
